From the seller we need

  • A copy of the title deed
  • A copy of the latest paid IBI (local property tax)
  • A copy of the latest paid electricity and water bill, also gas if you have
  • A copy of paid fee to the urbanisation, if the property belongs to such
  • Energy rating certificate
  • Valid occupation licence from the Town Hall
  • Copy of NIE and passport

Sellers costs are

  • 19% capital gains tax
  • Plus Valia (a local capital gains tax)
  • Cancellation of any depths on the property
  • Fee to the real estate agency
  • 3% of the salesprice will be retained and paid into the tax authorities on account of the vendors capital gains tax. If there is no capital gains, you can apply for a refund, provided you have fulfilled your tax obligations during the years you’ve owned the property

If you are planning to purchase a property in Spain you are required to have a NIE number. This is a Spanish tax identification number given by the Spanish police to any foreigner. We can asist you in obtaining this.

We advice everyone to use an independent lawyer when buying a property in Spain. The process is different from our country, and very often questions concerning other aspects as taxes and inheritance arise. Having your own lawyer is an essential back-up.
